These Terms & Conditions (“Terms”) govern your use of the Narayan Hotels & Resorts website, your booking with us, and any related services provided by Narayan Hotels & Resorts (“Narayan”, “we”, “us”, “our”). By accessing the site or making a reservation, you agree to these Terms. If you do not agree, please do not use our services.

1. Scope & Parties

These Terms apply to (i) direct bookings made on our website, via phone or email; and (ii) ancillary services we provide. In certain cases, we act as an agent for partner properties. When a hotel is operated by a partner, the partner’s terms may additionally apply and will be presented during the booking flow.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts under German law to make a reservation. You are responsible for ensuring that the information you provide is accurate and complete.

3. Booking Process

  • Offer & Acceptance: A booking is confirmed once you receive a booking confirmation email.
  • Special Requests: We will do our best to accommodate requests (e.g., late check-in), but they are not guaranteed unless explicitly confirmed in writing.
  • Group Bookings: 5+ rooms or special events may require additional terms, deposits, and cancellation rules.

4. Rates, Taxes & Payment

  • Displayed Prices: Prices are shown in EUR and include applicable German taxes unless stated otherwise. City/visitor taxes may apply by municipality.
  • Payment Methods: We accept major credit/debit cards and other methods shown at checkout. Your card may be pre-authorized or charged as per the selected rate plan.
  • Incidental Charges: Extras (minibar, spa, parking, etc.) are charged separately at the property.
  • Security Deposit: Certain stays may require a refundable deposit at check-in.

5. No Statutory Right of Withdrawal for Dated Stays

Under German Civil Code (BGB) for distance contracts, accommodation services with a specific date or period are generally excluded from the 14-day withdrawal right. Your cancellation rights are therefore determined by the chosen rate plan and the hotel’s policy.

6. Changes, Cancellation & No-Show

  • Flexible Rates: May allow free changes/cancellation until a specified deadline.
  • Non-Refundable Rates: Are charged in full and are not eligible for refund, except where mandatory law requires.
  • No-Show: If you do not arrive, the reservation may be cancelled and the applicable no-show fee charged (up to 100% of the first night or full stay, depending on rate).
  • How to Cancel: Use your confirmation email link or contact support; cancellation is effective upon our written confirmation.

7. Check-in, Check-out & Identification

  • Check-in: Typically from 15:00 (3 pm). Early check-in subject to availability and may incur a fee.
  • Check-out: Typically by 11:00 (11 am). Late check-out on request and may incur a fee.
  • ID & Registration: A valid government ID/passport is required; local registration obligations may apply.

8. House Rules & Guest Responsibilities

  • No smoking in non-smoking areas; cleaning fees may apply for violations.
  • Respect quiet hours and property rules; disruptive behavior may result in eviction without refund.
  • You are liable for damage caused by you or your party, beyond normal wear and tear.
  • Pets are allowed only in pet-friendly rooms and must be confirmed in advance; fees may apply.

9. Children, Extra Beds & Accessibility

  • Children policies and extra-bed/crib availability vary by property and room type.
  • Accessible rooms and facilities are available at selected hotels; please contact us for specific needs before booking.

10. Overbooking & Relocation

In rare cases of overbooking, we will arrange comparable alternative accommodation at our cost and provide reasonable transport where necessary. If no suitable alternative is available, you may cancel without penalty and receive a refund of any prepayments.

11. Third-Party Services

Some amenities or experiences (e.g., tours, transfers) are provided by third parties. We are not liable for third-party acts or omissions unless required by mandatory law. Their own terms may apply.

12. Liability

  • We are liable for intent and gross negligence as provided by German law.
  • For simple negligence, we are liable only for breach of essential contractual duties (cardinal obligations), limited to foreseeable, typical damages.
  • Liability for injury to life, body, or health remains unlimited as required by law.
  • We are not liable for unavoidable events beyond our control (force majeure), including but not limited to natural disasters, strikes, or governmental actions.

13. Intellectual Property

All content on our website (texts, images, logos, layouts) is protected by copyright and other IP laws. You may not copy, modify, distribute, or use content for commercial purposes without our prior written consent.

14. Reviews & User Content

By posting reviews or content, you grant us a non-exclusive, royalty-free license to use, reproduce, and display such content for marketing and service improvement. You warrant that your content is accurate and does not infringe third-party rights. We may moderate or remove content that violates these Terms.

15. Data Protection & Cookies

Your personal data is processed in line with our Privacy Policy. Cookie usage is described in our Cookie Policy. We comply with the GDPR and applicable German data protection laws.

16. Changes to These Terms

We may update these Terms from time to time. The current version is published on this page with the “Last updated” date. Material changes will apply to future bookings; existing bookings remain governed by the Terms in effect at the time of booking, unless mandatory law provides otherwise.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law rules. If you are a merchant or a legal entity under public law, the exclusive place of jurisdiction is Hamburg. For consumers, the statutory places of jurisdiction apply.

18. EU Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR) at ec.europa.eu/consumers/odr. We are not obliged and generally not willing to participate in consumer dispute resolution procedures before a consumer arbitration board.

19. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
